Terms and Use for Motorbah

Welcome to Motorbah (motorbah.com). These Terms and Use ("Terms") govern your access to and use of the Motorbah website and mobile application (collectively, the "Platform"), operated by Blok infiniti ("we," "us," or "our").
By accessing, registering an account, or using our Platform to browse or publish motorcycle listings, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Platform.
1. The Role of Motorbah
Motorbah is exclusively an online classifieds portal designed to connect buyers and sellers of new and used motorcycles.

We are not a party to the transaction: Blok infiniti is not a dealership, broker, or agent. We do not own the motorcycles listed, nor do we take part in the actual sale, payment, or transfer of ownership between buyers and sellers.

No guarantees: We do not guarantee the quality, safety, legality, or true condition of the motorcycles advertised, nor the ability of sellers to sell or buyers to pay for the vehicles.
2. User Accounts
To publish a listing or access certain features, you must register for an account.

Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.

Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

Account Termination: You may delete your account and all associated data at any time via the settings menu in the web or mobile app. We reserve the right to suspend or terminate your account without notice if you violate these Terms.
3. Listing Rules and User Conduct
When you publish a motorcycle listing on Motorbah, you agree to the following rules:

Accuracy of Listings: All information provided in your listing (including make, model, year, condition, mileage, and price) must be truthful and accurate.

Legal Ownership: You must have the legal right and authority to sell the motorcycle. Listing stolen vehicles or vehicles with undisclosed legal encumbrances is strictly prohibited and will be reported to the authorities.

Prohibited Content: You may not post content that is fraudulent, misleading, defamatory, offensive, or violates any third-party rights (including copyright of images).

One Item Per Listing: Each listing must represent a single, specific motorcycle available for sale. Spamming the platform with duplicate listings is prohibited.
We reserve the right to remove any listing at our sole discretion if we believe it violates these Terms or harms the integrity of the Platform.
4. User-Generated Content (UGC) and Zero-Tolerance Policy
Motorbah maintains a strict zero-tolerance policy regarding objectionable content and abusive users. By using the Platform, you agree not to post any content that is offensive, harmful, fraudulent, sexually explicit, or otherwise objectionable.
To ensure a safe environment, Motorbah provides built-in mechanisms for users to flag/report objectionable content and block abusive users.
Moderation and Enforcement: Our moderation team reviews all flagged content and user reports within 24 hours. Any user found violating this zero-tolerance policy will have their offending content immediately removed and their account permanently terminated without prior notice.
5. Interactions and Transactions

Proceed with Caution: You are solely responsible for your interactions with other users. We strongly advise users to meet in safe, public locations for viewings and to verify all documentation (e.g., geran/vehicle registration) before completing a transaction.

Disputes: Any dispute arising from a transaction is solely between the buyer and the seller. Blokinfiniti is not responsible for mediating or resolving disputes.
6. Intellectual Property
All content, design elements, logos, and software infrastructure on Motorbah (excluding user-generated listings and images) are the exclusive intellectual property of Blokinfiniti. You may not copy, scrape, reproduce, or distribute any part of the Platform without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by Malaysian law, Blokinfiniti and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of:

Your use or inability to use the Platform.

Any conduct or content of any third party on the Platform.

Any transaction or relationship between you and another user.
8. Indemnification
You agree to indemnify and hold harmless Blokinfiniti, its officers, directors, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your listings, or your violation of these Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any legal actions or proceedings arising out of these Terms shall be brought exclusively in the courts of Malaysia.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify users of any significant changes by updating the "Effective Date" at the top of this document or by sending a notification through the Platform. Continued use of Motorbah after such changes constitutes your acceptance of the new Terms.
